Attendees: Acting Chair William Nicholson, Roger Putnam, Manny Heyliger, Tom Reinhart, and Christine Bates, Committee Secretary.

Acting Chair William Nicholson opened the meeting at 7:00 pm and gave an overview of the procedures of the hearings.
William Nicholson stated since there is only 4 people serving the Board, it has to be unanimous.
Public Hearings:
09-02 Oberist, 275 Main St., Map 15, Parcel 55: Application for a Special Permit under WZB 6.1. to add a 24’ dormer to the front of house, additional set of outside stairs for a second egress, and two bay windows to front of house. The Board consisted of William Nicholson, Roger Putnam, Manny Heyliger, and Tom Reinhart. Stuart Oberist gave an overview of the project, stating the second floor apartment’s ceiling is extremely low, which is the reason he wants to add a dormer. He stated the additional stairs would be on the opposite side of the apartment and it is for safety reasons. A letter supporting the project from C.
Dimmitt was read into the record. Roger Putnam stated the existing window with ladder used as an egress would eliminate building a new set of stairs. Paul Murphy stated this type of egress and ladder is common in the cities, and it is pre-existing. He stated the dormer with windows will allow additional egress. The additional stairs will not be added to the project due to the legal egress currently existing. Roger Putnam moved for Findings of Fact:
1. The structure was built in 1955 according to assessors records.
2. The structure falls within the front yard and rear yard setbacks is nonconforming.
3. The lot is preexisting nonconforming due to lot size and frontage.
4. The proposed project will result in a volumetric increase within the setbacks.
5. The proposed bay windows will result in a further intrusion into the northerly/front setback.
6. There will be no change in use.
7. There will be no increase in use.
8. The change is not more detrimental to the neighborhood.
Tom Reinhart moved to approve the Findings of Fact; seconded by Roger Putnam; passed
4-0. Roger Putnam move to grant the Special Permit based on the Findings of Fact; seconded by Tom Reinhart; passed 4-0.
Other Business
Roger Putnam moved to adjourn at 7:36; seconded by Manny Heyliger; passed 4-0.
